TERMS & CONDITIONS OF ONLINE STORE

§1 General Provisions

  1. These Terms & Conditions (the “Terms”) set out the rules for using the online store available at https://thymka.com.

  1. These Terms govern, in particular:
    • the rules for placing orders,
    • the terms of the sales agreement,
    • payment and delivery methods,
    • the withdrawal and return process,
    • complaint procedures.
  2. The Terms are provided free of charge and can be downloaded, stored, and reproduced by Customers.

§2 Definitions

  1. Store – the online store operated by the Seller at [website address].
  2. Seller – the entity referred to in §1 of these Terms.
  3. Customer – an individual, legal person, or organizational unit placing an order in the store.
  4. Consumer – a natural person purchasing for purposes not related to business activity.
  5. Product – furniture and other items offered in the store.
  6. Order – a statement of intent by the Customer to conclude a sales agreement.

§3 Nature of Products

  1. Most products offered in the store are used, vintage, or antique items.
  2. Products may show natural signs of age and previous use, including:
    • scratches,
    • marks,
    • discoloration,
    • patina,
    • minor imperfections.
  3. These characteristics do not constitute a defect and are part of the item’s unique character.
  4. Each product is unique and typically available as a single piece.
  5. Product condition is described in the product description and shown in photos.
  6. Product colors may slightly differ from actual colors due to monitor settings.

§4 Placing Orders

  1. Orders can be placed via the online store 24 hours a day.
  2. To place an order, the Customer must:
    • select a product,
    • add it to the cart,
    • complete the order form,
    • accept the Terms,
    • make a payment.
  3. After placing an order, the Customer will receive an order confirmation email.
  4. The sales agreement is concluded once the Seller confirms the order.

§5 Prices and Payments

  1. All prices listed in the store are gross (including VAT).
  2. Prices do not include delivery costs unless explicitly stated otherwise.
  3. Available payment methods may include:
    • bank transfer,
    • online payments,
    • BLIK,
    • other methods available in the store payment system.
  4. The Seller reserves the right to change product prices, but changes do not affect orders already placed.

§6 Delivery

  1. Delivery is available within Poland and other countries specified in the store.
  2. Delivery may be performed by:
    • courier services,
    • furniture transport companies,
    • Seller’s own transport,
    • personal pickup.
  3. Delivery costs are displayed during order placement or agreed individually.
  4. Delivery time depends on the chosen delivery method.

§7 Right of Withdrawal

  1. Consumers have the right to withdraw from the purchase agreement within 14 days of receiving the product, without giving any reason.
  2. To exercise the right of withdrawal, the Customer must inform the Seller via:
  3. The product must be returned within 14 days from the date the withdrawal is notified.
  4. The Customer bears the direct cost of returning the product. Due to the size of furniture items, return costs may be substantial and require specialized transport.
  5. The Seller will refund payments within 14 days of receiving the returned product or proof of shipment.
  6. The Customer is responsible for any decrease in the value of the item resulting from handling beyond what is necessary to establish its nature, characteristics, and functioning.

§8 Complaints

  1. The Seller is responsible for non-conformity of the goods with the contract in accordance with applicable law.
  2. Complaints should be submitted via email to: info@thymka.com.
  3. Complaints must include:
    • Customer details,
    • order number,
    • description of the issue,
    • photos of the product (if possible).
  4. Complaints will be processed within 14 days.

§9 Personal Data

  1. The Seller is the administrator of personal data.
  2. Personal data is processed to fulfill orders and in accordance with the store’s Privacy Policy.
  3. Customers have the right to access and correct their personal data.

§10 Reservation of Products

Due to the unique nature of our products, the Seller does not guarantee the availability of any item after it has been sold. Adding a product to the cart does not constitute a reservation.

§11 Final Provisions

Changes to the Terms do not affect orders placed before the changes enter into force.

Matters not regulated in these Terms are governed by Polish law.

The Seller reserves the right to amend the Terms.
